The following general conditions (hereinafter, ‘General Conditions’) apply to all visitors (hereinafter, ‘User’ or ‘Users’) of the website www.versalis.eni.com (hereinafter, the ‘Website’), owned by Versalis S.p.A., a sole shareholder company subject to the management and coordination of Eni S.p.A., with registered office in Piazza Boldrini 1, 20097 San Donato Milanese (MI) (hereinafter, ‘Versalis’).
The General Conditions apply exclusively to the Website and not to www.eni.com, for which the terms and conditions set out therein shall apply.
1. How to use the Website
By accessing the Website, the User acknowledges the following:
a) use of the Website is at the sole risk and expense of the User;
b) access to the Website is granted to the User without payment of consideration, in the state in which the Website is found and without any promise and/or guarantee of validity and/or accuracy of the content and/or continuity of service provision;
c) the Website may not be supported by some browsers and/or operating systems on the market or by certain versions of them, and it is the User who identifies the correct combination of software and hardware that enables adequate enjoyment of the Website’s contents.
2. Changes to the General Conditions
Versalis reserves the right, at its sole discretion, to make any necessary changes to the General Conditions, appropriately advertising such changes on its home page. Changes to the General Conditions shall be effective from the date of their publication on the Website.
By continuing to use and/or access the Website after the changes made to the General Conditions have become effective as set out above, the User accepts the content as amended.
3. Industrial and intellectual property rights with regard to the Website
The User expressly acknowledges that all intellectual property rights, including, but not limited to, know-how, source code, software, hardware, designs, applications, patents, industrial secrets, formulas, algorithms, models, databases and the like, relating to the Website, data and other materials originating from Versalis or in any case made available to the User by Versalis under the General Conditions shall remain the exclusive property of Versalis and/or their respective owners and that no right, except that of exclusively personal use in accordance with the General Conditions, is granted to the User in relation to the above. The databases on which the Website is hosted (hereinafter, ‘Databases’) as well as the content contained therein are protected by copyright in accordance with Law No. 633 of 22 April 1941, as amended by Legislative Decree No. 169 of 6 May 1999 (hereinafter, ‘Copyright Law’). The Databases are also the subject of significant investments by the developer, Versalis, with consequent protection also under Article 102-bis and 102-ter of the Copyright Law. For the purposes of the aforementioned protection, the only permitted use of the Databases on the part of Users is that made in accordance with the General Conditions. In no event shall the General Conditions be construed as granting Users the right to extract and/or reuse all or a substantial part of the Data.
4. Prohibition on commercial use of the Website
The User's right to use the Website is personal and non-transferable. The User may only access the Website as a natural person for strictly personal use and in any case not for gain, profit or for the purpose of obtaining an economic benefit. The User is prohibited from incorporating any of the contents extracted in connection with the use of the Website in any intellectual property. The User is forbidden to reproduce, publish, distribute, set up databases, translate, adapt, duplicate, copy, sell, subject to framing or deep linking, resell and in any case exploit for commercial purposes or for profit or gain any part or parts of the Website or any extract from the Databases, as well as use of or access to the Website.

Versalis reserves the right to provide links to other websites or other resources on the Internet. The User acknowledges and recognises that Versalis has no control over the content of such websites and, as a mere third party, has no responsibility for the content and/or material, including advertising material, disseminated on such websites or external resources or for the products or services offered therein. Such products or services cannot be considered in any way sponsored, shared or supported by Versalis and therefore the User accepts all liability for any purchases made of such products or services.
6. Limitation of liability
Versalis declines all liability in the event that the User is unable to use the Website for any reason whatsoever. Versalis therefore accepts no liability whatsoever for damages, claims and/or losses, direct or indirect, suffered by the User if the User is unable to use the Website or for any failure and/or defective operation of the electronic equipment of the User or of third parties, including Internet Service Providers, telephone and/or telematic connections not directly managed by Versalis or by persons for whom it is responsible.
Versalis cannot be held in breach of its obligations or liable for damages:
a) resulting from the Website being inaccessible or failing to operate due to the malfunctioning or failure of the electronic means of communication owing to causes beyond the User's foreseeable control, including but not limited to fire, natural disasters, power failure, unavailability of telephone lines or other network service providers, malfunctioning of computers and other electronic devices, including those not forming part of the Internet network, malfunctioning of computer programmes installed by the User;
b) arising from the actions of other Users or other persons with access to the Internet.
7. Use for lawful purposes and indemnity
The User undertakes to use the Website solely for lawful purposes permitted by the applicable legal provisions in force, by custom and practice, by the rules of diligence, in any case without infringing the rights of any third party, whether or not a User of the means of communication, and with particular regard to data protection regulations, laws on the protection of intellectual and industrial property, the protection of personal data, current legislation concerning cybercrime and telecommunications. The User accepts full responsibility for the content of the messages and texts that the User sends, acknowledging sole responsibility and releasing Versalis, as well as the subjects linked to it or controlled by it, its representatives, employees as well as any partner of Versalis from any consequent claim for damages or compensation, reimbursing Versalis for any cost incurred by it and deriving from claims and/or actions of third parties against it for damages caused by the User or persons authorised by the User to access the Website. Any information and/or material supplied by any User to Eni through the Website will not be considered confidential or proprietary. Therefore, no obligation will arise for Versalis with respect to such information and/or material. Versalis reserves the right to use such information and/or material in the manner it deems appropriate.
8. Governing Law
The General Conditions shall be governed by and construed in accordance with Italian law. Failure to exercise any right under the General Conditions does not imply a waiver of this right. Should any provision of the General Conditions be deemed invalid as a result of legal proceedings, the remaining provisions will continue to apply.
9. Processing of personal data
By accessing the Website, the User declares that he/she has read the information on the personal data processing by navigating the Website and using its services (Privacy Policy), as well as on the use of cookies and similar technologies (Cookie Policy). Any data the User provides by filling in the appropriate fields provided by other websites to which the links on the Website refer, as provided for in Article 5 above, will be processed in accordance with the privacy policies provided in those websites by their data controllers, and we recommend that the User consult them.
